Reviews and inquiries into insolvencies in the construction industry

The Government is continuing its ongoing work to address concerns with project funding, payment claims and retentions. Reforms 26, 38 and 40 that relate to reviewing the recommendations of previous inquiries into insolvencies in the construction industry are now complete.

The review has found that the relevant issues raised in the recommendations are either already addressed, or being considered, under other ACT reforms, and in national work under the Building Ministers' Forum.

Further, the ACT's building regulatory reform program includes reforms not suggested by the recommendations of any of the national reports, including helping to prevent phoenixing by allowing the Construction Occupations Registrar to consider the history of individuals, directors, partners and nominees under other (related) licences, and for actions to be taken across related licences if appropriate.
