• Development specified as additional code track development in a suburb precinct code for land shown on the relevant suburb precinct map; and
  • Single dwelling housing that complies with the relevant rules, except where exempted from requiring development approval by section 20 and schedule 1 of the Planning and Development Regulation 2008 may also be lodged as a code track development and:
  • Varying a lease in residential zones only to do one or more of the following: 
    1. express the number of approved or lawfully erected dwellings
    2. remove, relocate or change easements.
     

Lease variation Code track documentation requirements

The documents required for a variation to specify the maximum number of dwellings permitted are:

  • Application form completed on eDevelopment
  • Letter of Appointment from the lessee(s) (if relevant)
  • Statement against the relevant Criteria (particularly addressing Residential Zones Development Code rules 2 & 39, 46, 65 and the Lease Variation General Code rule 7)

The documents required for a variation to the easements in a Crown lease are

  • Application form completed on eDevelopment
  • Letter of Appointment from the lessee(s) (if relevant)
  • Statement against the relevant Criteria (particularly addressing Lease Variation General Code rule 8)
  • Agreement/clearance from the relevant utility provider. For example TAMS or ACTEW if a service easement
  • A plan showing the relocation if the easement is being varied and not being deleted, preferably annotated by the party granted the easement.

Note: *It is not unusual for more than one lease to be affected by this type of application. Agreement from the neighbouring lessee affected is required.
