Recommended variations to the Territory Plan

DV360 Molonglo River Reserve

Draft Variation 360 (DV360) proposes to make changes to the public land reserve overlay boundaries and a minor zone adjustment on the Territory Plan Map for the area of the Molonglo River Reserve. These amendments are necessary in order to align the Territory Plan Map with the provisions in the Molonglo River Reserve – Reserve Management Plan. The changes will fulfil the requirements for the Reserve Management Plan to be finalised and take effect.

Interim Effect

Section 65 of the Planning and Development Act 2007 applies to DV360. This means that the provisions of Draft Variation No 360 have interim effect, and apply to development applications lodged on or after 23 November 2018.

During the period of interim effect the ACT Government must not do or approve anything that would be inconsistent with the Territory Plan as if it were amended by the draft variation. Where there is an inconsistency between provisions in the current Territory Plan and provisions in the draft variation, then the draft variation takes precedence for the extent of the inconsistency.

Interim effect will end on the day the earliest of the following happens:

  1. the day the public availability notice under section 70 for the draft variation being recommended to the Minister is notified in accordance with the Legislation Act
  2. the day the draft variation, or the corresponding variation, is withdrawn under section 68 (1)(b) or section 76 (3)(b)(v)
  3. 1 year after the date of the consultation notice.

Community engagement was undertaken in early 2018 on the Molonglo River Reserve Draft Reserve Management Plan. The ACT Parks and Conservation Service team are currently reviewing submissions received during the consultation period. DV354 Water Sensitive Urban Design

Draft Variation 354 (DV354) revises the waterways: water sensitive urban design general code (WSUD code) and proposes a number of associated consequential amendments to Territory Plan codes. The WSUD code has been reviewed in response to the ACT Government’s WSUD Review Report which was released in 2014 (WSUD Review). The WSUD review called for a revision of the WSUD provisions in the Territory Plan and for these provisions to be supported by a WSUD practice guideline.

The associated consequential Territory Plan amendments ensure that the water sensitive urban design provisions applying across all zones will now be located in the one place, being the WSUD general code. This excludes any site specific provisions which are contained in the relevant suburb precinct codes and the mains water reduction targets for single dwellings and secondary residences which will be retained in the single dwelling housing development code.

Interim Effect

Section 65 of the Act does not apply in relation to the Draft Variation and therefore it does not have interim effect. The current Territory Plan will continue to apply while the Draft Variation remains in draft form.

 

DV355 Calwell Group Centre

Draft Variation 355 Calwell Group Centre (DV355) proposes changes to the Calwell Precinct Map and Code in the Territory Plan. DV355 proposes to implement the planning related recommendations of the Calwell Group Centre Master Plan 2016. It seeks to rezone land and to amend the Calwell precinct map and code consistent with the master plan.

What happens with your comments?

Comments will be made publicly available, for a period of at least 15 working days starting 10 working days after the closing date, at EPSDD’s Shopfront in Dickson and will be published on EPSDD’s website.

Can you request your comments not to be made public?

Yes, under section 411 of the Act part of the comments can be excluded and made unavailable to the public upon request. You will need to put your request in writing, clearly identifying what you are seeking to exclude and how the request satisfies the exclusion criteria. Please note that name and contact details and other personal information will not be made public unless requested.

Are the changes to the Territory Plan effective immediately?

Section 65 of the Act applies to DV355 and therefore it has interim effect.  This means that the provisions of DV355 apply to development applications lodged on or after 10 August 2018.
