What is a pre-application meeting?

Pre-application meetings allow people to seek advice on development proposals before they submit a development application.

These meetings are a good opportunity to raise or identify issues that may arise when an application is assessed, and in some cases resolve these issues before a development application is finalised.

Advice given at these meetings generally relates to issues around interpretation and application of the Territory Plan, the Planning and Development Act and the requirements of other government agencies.

Is there a fee for a pre-application meeting?

There is no fee for booking or attending a pre-application meeting. However if you wish to have formal advice in writing this will attract a fee (information on applying for written advice is provided later in this brochure).

How do I book a pre-application meeting?

Pre-application meetings are held at specific times on specific days (depending on the proposal), so it is essential you ring Customer Services on 6207 1923 and make an appointment. Alternatively, you can request a pre-application through e-Development (if you already have a username and password). You can also book a meeting at the EPD Customer Service Centre – 16 Challis Street, Dickson.

When booking the meeting you will be asked a series of questions about your proposal so the relevant people can be invited to attend the meeting, and information you will need to provide can be determined.

An example of some of the questions you will be asked include:

  • Block, Section and Suburb of proposed development site
  • Description of the proposed works
  • Are there any protected trees on site?
  • Is the development site in a heritage area?
  • Is there any proposed works on the verge?
  • Does the development proposal include a change to the lease?
  • Will the proposal involve unit titling?
  • Are you aware of any issues relating to the site?
  • Do you have the property owner’s authorisation?

You should also provide Customer Services details of who will attend the meeting.

What information do you need to provide?

The following information should be provided to Customer Services no less than 5 days before the meeting:

  • written Lessee’s authority (if proponent is not the lessee of the proposed development site)
  • a concept plan of the proposed development – drawn to an appropriate scale
  • details of particular Rules or Criteria in the relevant code that you wish to seek advice on
  • details of any departures from the Territory Plan
  • details of the zone and development /precinct code/s that apply to the proposed development
  • details of any consultations with other government agencies (Heritage, Asset Acceptance, Environment ACT etc)
  • any other relevant supporting documentation.

Providing these documents before the meeting allows some preliminary consideration to be undertaken. This ensures your meeting will be as informative as possible.

How long is a pre-application meeting and who attends?

Pre-application meetings are limited to a maximum duration of one hour.

The pre-application meeting will generally be attended by a case officer from the assessment area that will deal with your proposal once it has been formally lodged as a development application.

Officers representing other government agencies may also be invited to attend a pre-application meeting where relevant. Please note their attendance may not be possible.

Record of the meeting

During the meeting the case officer will take notes about what’s been discussed, the issues raised and the advice given. The case officer will save a copy of these notes in the relevant EPD file and provide you with a copy for your records. A record of the meeting does not attract a government fee.

Written pre-application advice on development proposals

What is written pre-application advice?

EPD can provide the following information in writing to a proponent:

  • which assessment track is likely to apply to a proposal, or if the proposal is likely to be exempt or prohibited
  • whether the proposal will be required to be referred to an entity/s
  • whether public notification will be required
  • whether the development proposed is consistent with existing lease conditions applying to the land where the development is proposed to take place
  • generally what further information may be required.

How do I apply for this advice?

You need to fill out a pre-application advice application form, provide plans and other supporting documentation detailing the development proposal you are seeking advice on and pay the prescribed fee.

When does the advice expire?

Pre-application advice will expire six months from the date it is given.

Disclaimer:

EPD may act inconsistently with any advice provided in relation to a development proposal if:

  • the environmental circumstances surrounding the development proposal change; or
  • the development proposal for which development approval is sought is different from the proposal in relation to which the advice was given; or
  • when the proponent asked for advice, the request did not include relevant information; or
  • the Territory Plan changes after the advice is given and before EPD acts; or
  • the advice given was inconsistent with the Territory Plan because of an error.
