The compliance certificate framework implemented under the scheme is separate to the existing certificate of occupancy and use (COU) requirements under the Building Act 2004.

COUs are required for most building work. COUs verify that building work is built in accordance with approved plans, and is compliant with relevant laws and standards. This includes for the construction of swimming pools and pool safety barriers. It is against the law to occupy or use a building or structure until a COU is issued.

Compliance certificates are a requirement from 1 May 2028 for certain regulated swimming pools at certain times. Compliance certificates verify the compliance of a regulated swimming pool’s safety barrier with the prescribed safety standards under the scheme.
