What is a Notice of Decision?

A Notice of Decision (NoD) is a statutory document that advises the outcome of a Development Application (DA), and reasons on why a DA was approved, conditionally approved or refused.

A NoD is issued to the DA applicant for each decided application. Anyone who submitted a representation on the DA will also receive a copy of the NoD.

What is the Structure of a Notice of Decision?

A Notice of Decision is typically structured as follows:

Cover Page: The Cover Page identifies:

  • the block details of the site
  • a description of the proposal
  • whether the DA has been approved, conditionally approved or refused
  • the name and signature of the delegate of the planning and land authority
  • contact details.

PART A: Conditions of Approval: When the DA is approved, Part A includes:

  • the timeframes for commencement and completion of the subject development
  • any conditions relating to the proposal in response to Territory Plan
  • any leasing conditions and requirements
  • conditions relating to referral entity and public comments
  • any other conditions.

PART B: Reasons for the Decision: Part B highlights the reasons for an approval, conditional approval or a refusal of the DA. This typically includes:

  • why it was considered to meet, or not meet, the Territory Plan requirements
  • the relevant legislative assessment requirements
  • the relevant Territory Plan zone, Development Code/s, Crown Lease details, summary of who provided entity advice and the amount of representations received.

PART C: Public Notification and Entity Advice: Part C typically includes:

  • details of the public notification period
  • the number of representations (if any) received
  • this may also include a brief response to any significant issues raised in the representation/s
  • A summary of the entity advice.
