Under the previous Planning and Development Act 2007, proponents had the ability to apply for an Environmental Impact Statement (EIS) exemption, rather than an EIS.
This has been removed from the Planning Act 2023. This means an EIS exemption is no longer able to be applied for. Any developments that require an EIS are required to follow the EIS process.
Transition arrangements
Current EIS exemption applications are able to continue to completion.
EIS exemptions that were granted by the Minister are also able to continue to be relied on, until they expire. Any EIS exemption that was granted and is still valid is considered to be a finalised EIS under the Planning Act 2023.
