Licence holders must notify the Registrar in writing within 14 days of becoming aware of certain changes or events.
You must notify the Registrar if there is a change to:
- your name
- your contact details
- an associated entity that becomes or ceases to be associated with your organisation
- a key person who becomes or ceases to be involved with your organisation
- any information previously provided in a licence application or licence renewal application.
You must also notify the Registrar if you or an associated entity:
- enter into an off-the-plan contract for the sale of a regulated residential building
- apply for a development approval relating to residential building work
- apply for a building approval relating to residential building work.
The Registrar may request a new rating report if a licensee notifies of a change in circumstance.
Timeframes for notification are legislated in the Property Developer Act 2024 and are also listed below; these must be adhered to:
- within 14 days: notify the Registrar of a change in circumstances
- within 28 days: respond to a proposed licence variation initiated by the Registrar after receiving notice.
Failing to notify the Registrar of a change in circumstances is a strict liability offence, which means a person may be held responsible regardless of whether the failure to notify was intentional.
