PLANIT Strategic has lodged an application on behalf of Capital Estate Developments Pty Ltd for an EIS exemption under section 211B of the Planning and Development Act 2007 for an Estate Development Plan (EDP) at Block 12, Section 1, Denman Prospect.

The proposal seeks to extend urban development into Block 12, Section 1, Denman Prospect (the deferred area). The deferred area was identified in the EIS exemption for Molonglo Valley Stage 2 (NI2013-338) as requiring further investigations, where as part of the EIS exemption for the deferred area (NI2017-183) it was then highlighted to only be used as an asset protection zone.

The proposal area is intended to form part of EDP1 for the Denman Prospect 2 Estate. EDP1 proposes approximately 900 single and multi-unit dwellings, a primary school site, recreational areas, bushfire protection zones and associated infrastructure works.

Overview of EIS exemptions

Section 211 of the Planning and Development Act 2007 allows for a proponent to seek exemption from the requirement to complete an Environmental Impact Statement. The Minister has discretion under this section to grant an exemption if satisfied that previous studies have adequately identified the potential environmental impacts of the proposal.

A proponent may apply for an EIS exemption for any proposal that would trigger an EIS under Schedule 4 of the Planning and Development Act 2007.

Public representations

The public consultation period for an EIS exemption application is a minimum of 15 working days. The consultation period for Denman Prospect 2 Estate was from 18 December 2021 until 10 February 2022 which was longer as the period fell over the Christmas Shutdown. Representations received during the consultation period are disclosed below.
