MA2024-e - Changes to the Inner North and City District Policy

This minor amendment proposes to change the Inner North and City District Policy by adding a new policy outcome for the City Centre Entertainment Precinct and replace Figure 14 with a revised figure to show the Frame and Core areas in the precinct.

The City Centre Entertainment Precinct (CCEP) Core is an area within the CCEP supporting a clustering of higher noise emitting entertainment venues away from any currently constructed residential and commercial accommodation.

The Frame makes up the remainder of the CCEP. The Frame contains a variety of venues which contribute to the entertainment scene, with existing residential and commercial accommodation developments within and adjacent to the CCEP Frame. The Frame supports entertainment uses while acting as a transition zone between the Core and the areas adjacent to the City Centre Entertainment Precinct.

MA2024-d - Clarification of assessment requirements

Minor Plan Amendment 2024-d – Clarification of assessment requirements in district policies, Residential Zones Policy, Subdivision Policy, and Dictionary clarification.

This minor amendment proposes to make changes to various provisions in the district policies, Residential Zones Policy, Subdivision Policy and to a definition in the Dictionary in the Territory Plan.

The proposed changes to the district policies is to make it clear that there is flexibility in addressing the requirements regarding replacement car parking where redevelopment is possible. This is similar to the wording in the precinct codes in the previous Territory Plan.

The proposed changes to the Subdivision Policy is to restore existing development rights to lessees of blocks where multi unit housing (including dual occupancy development) received approval, were lodged, or substantially submitted before the new Territory Plan took effect on 27 November 2023. This will permit these developments to still be unit titled.

The proposed changes to the site coverage provisions for multi unit housing in the Residential Zones Policy is to make it clear that the requirements apply to the original block, where subdivision of a block is proposed. This will make sure that sufficient area is available for soft landscaping and tree canopy cover.

An example use of ‘plant and equipment hire’ is proposed to be added to the definition of ‘industrial trades’ in the Dictionary in the Territory Plan. This will make it clearer what types of uses that can be considered under the definition.

MA2024–d proposes to:

  • Amend all the district policies to clarify that where development is proposed on identified surface car park sites in the town and group centres, car parking allocation provides for the development and makes a substantial contribution to the long term parking supply for the town or group centre.
  • Amend Assessment Requirement 1 in the Residential Zones Policy about site coverage for single dwellings to add a note to clarify that single dwelling includes all associated Class 10 buildings.
  • Amend Assessment Requirements 2 and 3 in the Residential Zones Policy to clarify that site coverage for multi unit housing in the RZ1-RZ5 zones is calculated on the original block area where the block is to be subdivided under the Planning Act 2023.
  • Amend Assessment Requirement 14 in the Subdivision Policy to clarify that development applications for multi unit housing (including dual occupancy development), on blocks considered to be non-standard blocks in the RZ1 zone under the previous Territory Plan, that were approved, lodged or substantially submitted before 27 November 2023, these developments can still be unit titled.
  • Amend definition of industrial trades in Part G Dictionary to include plant and equipment hire as an example use.
