The project
The Suburban Land Agency proposes to construct the Deep Creek Corridor Regional Water Quality Pond on Blocks 2 and 9, Section 39 in Whitlam (now known as Block 10, Section 39 Whitlam). The proposal will include the construction of a pond approximately 350 metres upstream of the Molonglo River in Deep Creek. The pond will have a storage capacity of 64 megalitres and a surface area of 28, 404 square metres. Other key features of the proposal include the construction of a 22.7 metre high and 300-metre-long embankment, spillway, outlet, road crossing, access tracks, erosion protection and perimeter works.
The pond is proposed to manage and treat urban stormwater runoff from the Whitlam Estate prior to discharge to the Molonglo River. The embankment of the pond will provide an additional access route between Stages 1 to 3 and Stage 4 of the Whitlam Estate Development, and convey utility infrastructure to Stage 4 including water, electricity, and telecommunications.
EIS process
The Environmental Impact Statement (EIS) details the anticipated environmental impacts of a development, as well as proposing avoidance and mitigation measures. A proponent prepares an EIS to enable decision makers to understand the likely environmental consequences of a proposed development. The EIS is required to address matters raised in the scoping document for the proposal. Read more about the EIS process.
The final EIS informs the development application (DA) which is the decision-making and approvals process. In the DA process, matters raised in the EIS are assessed against the requirements of the Territory Plan and the Planning and Development Act 2007.
Public consultation
In accordance with the Act, the proponent prepared and submitted a draft EIS to the planning and land authority. The draft EIS was open for comments for 20 working days, commencing on 20 July 2021 and closing on 16 August 2021.
Two public representations were received during the public consultation period.
Current status: EIS process complete
The Delegate of the planning and land authority provided the final EIS and an EIS assessment report to the Minister for Planning and Land Management who, on 25 October 2023, decided to take no action on the EIS, meaning the EIS process is now complete.
The proponent can now submit a Development Application (DA) for this proposal for assessment, where it will undergo a separate assessment process informed by the EIS. The DA assessment will consider whether the potential environmental impacts of the proposal are acceptable and also consider any community representations made during the public notification period for the DA.
